1 Temporary Event Notice: In the paper world the practice was for an authority to complete some additional form details and return a copy of the application back to the applicant. How does it work in the electronic world?

Under Section 32 of the Provision of Service Regulations 2009, an application can be dealt with entirely electronically. It is sufficient for an authority to simply approve the application received via the PSC or allow approval to deemed given by expiration of the tacit consent period. In the former case, an authority may want to send its own standard response to an applicant using the message box facility so that they can then use to demonstrate approval.

2 Temporary Event Notice: Are TENs applications from businesses different to hose from individuals?

In practical terms many activities regulated under a TEN are in fact undertaken by a business and the application is only made because a business wishes to perform the activity. This is one reason why the TEN is caught by the Provision of Service Regulations 2009 and BIS's view is that a business can be an applicant.

Every form supplied through ELMS nevertheless requires that a person completing an application supplies at least their name, so that a person can be held accountable for the application. A wording change to the PSC form will be issued shortly, reinforcing that point to an applicant. In the meantime BIS believe that you are quite entitled to process the form.
