Congratulations on going live!

We know it has been a difficult task for some to reach this point and we appreciate all your efforts in getting here. Now you are live, the key thing is making sure you are fully compliant with the EU Services Directive and, just as importantly, continue to be so.

We have therefore provided a final checklist to help you ensure you are meeting all the requirements of the Directive.

Final checklist for Local Authorities using Businesslink Forms - Mode 3

  1. All of the formalities regulated by your authority must be deployed in ELMS
    • English County Councils are expected to have 8 to 13 formalities deployed
    • English District Councils are expected to have 25 to 35 formalities deployed
    • English, Scottish and Welsh Unitary Authorities are expected to have 33 to 48 formalities deployed
    • Northern Ireland are expected to have 12 to 19 formalities deployed
    • This is ONLY including a formality once, i.e. premises licensing would count as 1
  2. Check that there are no instances of duplication between your County and District Councils - only one can be responsible for a specific formality
  3. Make sure each formality you have deployed has the correct Tacit Consent shown. For more information on what formalities are available please check the Formalities List spreadsheet for the standard formalities and the Local Acts in England and Wales page for details of Local Acts.
  4. Once you have deployed your form on ELMS you should make sure it is available on your authority website via a link. If you are having any difficulties creating these links, the Formality List spreadsheet has an updated list of links available for you to use.
  5. Some forms have recently been changed and you may therefore need to redeploy some forms that you have already deployed. Please refer to the Form Redeployment Update page to check if you need to redeploy a specific form.

The checklist is not exhaustive but will give you an overview of key points to be monitored. These points will also be checked by BIS and by SOCITM, who have been commissioned to carry out a survey of authorities websites regarding compliance with the Directive.

As you make progress deploying your formalities you may come across some issues or queries about how to use the system.

If this happens, you should first go to the Solution Centre to see if this problem and a solution are already listed under Known Issues. You will also be able to access a full set of FAQs within the Solution Centre that may also help you answer any outstanding queries.

If your particular query is not listed or you are unable to find the solution to your query, you should complete the feedback form to raise a new query/issue and request assistance from the ELMS Support Team.
